AB-64 as introduced, did not amend the “not for profit” language set forth in Health & Safety Code Section 11362.765

Health and Safety Code Section 11362.765 sets forth criminal liability for marijuana related offenses as follows:

  Subject to the requirements of this article, the individuals specified in subdivision (b) shall not be subject, on that sole basis, to criminal liability under Health and Safety Code Sections 11357 [possession], 11358 [cultivation, harvesting, and processing], 11359 [possession for sale], 11360 [transportation, sale, furnishing, or administration], 11366 [maintenance of place for purpose of unlawful sale, use, or furnishing], 11366.5 [making place available for purpose of unlawful manufacture, storage, or distribution], or 11570 [place used for unlawful sale, serving, storage, manufacture, or furnishing as statutory nuisance].   However, nothing in this section shall authorize the individual to smoke or otherwise consume marijuana unless otherwise authorized by this article, nor shall anything in this section authorize any individual or group to cultivate or distribute marijuana for profit.

AB 64 as introduced did not amend the not for profit language set forth in Health and Safety Code Section 11362.765.
